Limited Lifetime Workmanship Warranty Details
Warranty:
When EXOVATIONS of Atlanta, LLC ("EXOVATIONS") supplies material and labor for the installation of roofing and/or gutter systems for an owner-occupied, single-family residential home, EXOVATIONS warrants that its installation workmanship will be free from defects and will be accomplished according to manufacturers' installation instructions or accepted industry standards and practices.
Who is covered:
This warranty extends to the original homeowner that purchased the roofing or gutter improvements from EXOVATIONS and to the first party that thereafter acquires, directly from such original homeowner, fee title to the home where such improvements were completed. This warranty is not transferable beyond the first party that acquires fee title to the home directly from the original homeowner.
Warranty term:
With respect to the original homeowner that purchased the improvements from EXOVATIONS, the warranty coverage is in effect for as long as such homeowner owns and occupies the home where the improvements were completed. With respect to the first party that acquires fee title to such home directly from the original homeowner, the warranty coverage is in effect for a period of 5 years from the completion of the work. See applicable exclusions below.
What is covered:
In the event of a valid warranty claim, EXOVATIONS will furnish labor to repair any defective installation workmanship. EXOVATIONS will also supply replacement materials when necessary to make such repairs. EXOVATIONS reserves the right to substitute materials that it believes are of equal value if materials identical to those originally installed are no longer readily available to EXOVATIONS when such repairs are performed. All replacement work and materials will be provided solely by EXOVATIONS or by parties designated by EXOVATIONS. The homeowner may not contract with another to provide such labor or materials unless otherwise directed in writing by EXOVATIONS. Repairs undertaken by the homeowner or third parties without the written approval of EXOVATIONS will void this warranty.
What is not covered:
This warranty does not cover damage related to acts of God, weather conditions, storm damage, fire, flood, earthquake, moisture, water, humidity retention or accumulation, mildew, mold, settlement or deterioration of the building structure, improper care, adverse effects of pollution, normal surface wear, accidental or intentional damage, manufacturing defects, failure of materials, or any cause beyond EXOVATIONS' control. In addition, this warranty does not cover routine maintenance (e.g., cleaning gutters or inspecting flashing). EXOVATIONS WILL NOT BE LIABLE IN ANY EVENT FOR CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING DAMAGE TO THE INTERIOR OR EXTERIOR OF ANY RESIDENCE WHETHER FOR BREACH OF THIS WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT, OR FOR ANY OTHER CAUSE. The total liability of EXOVATIONS for claims under this warranty shall be limited to, and in no event shall exceed, in the aggregate, the total installed cost of the roofing and/or gutter products originally installed by EXOVATIONS.
Modification of warranty:
This warranty may not be changed or modified except in writing, signed by an authorized officer of EXOVATIONS.
Sole and Exclusive Warranty:
THIS WARRANTY IS EXOVATIONS' SOLE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED. EXOVATIONS DISCLAIMS ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This warranty does not replace any warranties made by the manufacturer of the materials installed by EXOVATIONS, and any claims relating to defective materials should be made directly to the manufacturer of such materials as stated in its written warranty.
